UPERC Allows UPNEDA To Withdraw Petition Seeking Amendments To RPO Regulations

The Uttar Pradesh New & Renewable Energy Development Agency (UPNEDA) had filed a petition seeking amendments to the Uttar Pradesh Electricity Regulatory Commission (UPERC) regulations on the Promotion of Green Energy through the Renewable Purchase Obligation (RPO). The petition aimed to align the state’s RPO framework with the trajectory set by the Ministry of Power, Government of India, as per an order issued on July 22, 2022, and its subsequent corrigendum.

During a previous hearing on December 10, 2024, the petitioner was not present. The Commission, in its order dated December 24, 2024, granted UPNEDA another opportunity to pursue the case. However, in the latest hearing, the petitioner’s counsel stated that the petition had been filed in June 2023 for formal adoption, but due to several policy and regulatory changes since then, the petition was no longer relevant in its current form. As a result, UPNEDA requested permission to withdraw the petition.

The Commission reviewed the request and noted that the relief sought in the petition fell under its legislative functions. Even if the petitioner had proceeded with the case, the Commission would not have been able to grant the request in its current form. Since the petitioner no longer wished to pursue the matter, the Commission accepted the withdrawal request and officially disposed of the petition.

This decision indicates that amendments to the RPO regulations in Uttar Pradesh may require a fresh petition reflecting the latest policy changes. The Commission’s ruling highlights the importance of aligning regulatory requests with ongoing policy developments to ensure compliance with national renewable energy goals.
