NERSA Invites Stakeholders To Public Hearing On Draft Electricity Mediation And Arbitration Rules

The National Energy Regulator of South Africa (NERSA) has invited members of the public and industry stakeholders to participate in a public hearing on proposed new rules for mediation and arbitration in the electricity sector.

The hearing is being conducted under Section 30(3) of the Electricity Regulation Act, 2006, as amended. The provision allows NERSA to establish procedures and fee structures for alternative dispute resolution mechanisms, including mediation and arbitration.

The proposed rules are intended to provide a formal framework for handling disputes through these processes within the electricity sector. NERSA is seeking comments and views from interested parties before finalising the rules.

The public hearing is scheduled to take place virtually on October 16, 2026, from 09:30 to 12:00 through Microsoft Teams. Stakeholders who wish to make a presentation or attend the hearing are required to submit their requests by 16:30 on Monday, October 12, 2026.

NERSA has stated that the hearing will only proceed if stakeholders register to make presentations on the draft rules before the deadline. If no stakeholder registers to present, the hearing will be cancelled. Registered participants will be informed directly about any cancellation, while an official notice will also be published on the NERSA website.

The complete draft mediation and arbitration rules are available on NERSA’s official website under the Electricity consultation notices section. Interested parties may also request copies directly from the regulator.

The consultation provides an opportunity for electricity industry participants and members of the public to share their views on the proposed dispute resolution framework and contribute to its development before the rules are finalised.
