GERC Reviews Dispute Over 11.5 MW Solar Plant Capacity Restoration In Gujarat

Kundan Solar (Astronfield) Pvt. Ltd., formerly known as Astronfield (Gujarat) Pvt. Ltd., has filed a petition before the Gujarat Electricity Regulatory Commission under Section 86(1)(f) of the Electricity Act, 2003. The petition pertains to a dispute between the petitioner and Gujarat Urja Vikas Nigam Ltd. (GUVNL) regarding the petitioner’s solar power project. The company has sought adjudication related to the generation of solar power at its full installed capacity of 11.5 MW under the terms of the Power Purchase Agreement (PPA) dated April 30, 2010, and the amended PPA dated August 7, 2010. The company wants to restore the plant to its full potential by undertaking necessary repairs.

The petition was accompanied by an Interim Application (IA No. 16 of 2025), seeking interim directions from the Commission. The matter was heard on June 26, 2025. The respondent submitted that the petitioner had not provided some critical information.

Despite notices served through RPAD and email, the objector, did not appear, nor did he notify the Commission of any inability to attend.

During the hearing, the Commission raised several queries regarding the documentation required from the petitioner. These include the information memorandum prepared by the resolution professional, the deed of confirmation for the handover of physical possession, the resolution plan proposal and submitted bid, the decision of the Committee of Creditors, and relevant orders from the NCLT, NCLAT, and higher forums. The Commission also requested a contour report of the project site to understand issues related to waterlogging caused by heavy rainfall, including the natural flow of rainwater, site levelling, and measures to avoid flooding. Additionally, technical specifications of the modules and inverters were also sought.

The petitioner agreed to provide the required documents and information. The Commission noted that arguments from both sides were complete and gave both parties the liberty to file any further written submissions within four weeks. The Commission directed the petitioner to submit the pending documents within this same timeframe, with a copy also sent to the respondents.

The matter has been scheduled for the next hearing on August 19, 2025, at 11:30 AM. This hearing will focus on the documents submitted and any issues that may arise.
