A group of US states is suing over Donald Trump’s latest attempt to use a shifting set of federal statutes as a legal basis for his global trade war, adding to similar lawsuits by groups of small businesses that contend the levies — like many previously tried by the Republican president — are illegal.

The filing Monday in the US Court of International Trade in Manhattan sets up a now-familiar clash, with separate coalitions of states and small businesses locked in a fight with the administration over tariffs based on arguably questionable legal foundations. The lawsuits accuse Trump and US officials of unlawfully using Section 301 of the Trade Act of 1974 to replace earlier tariffs that were either struck down by the US Supreme Court or expired.
The latest litigation comes as the administration continues to face fallout from its original April 2025 tariffs. In the months since the high court ruled those illegal, customs authorities have had to contend with refund demands from thousands of businesses that paid the roughly $166 billion in tariffs collected.
