BERC Proposes Draft RPO Regulations 2025 To Boost Renewable Energy In Bihar

The Bihar Electricity Regulatory Commission (BERC) has released a draft regulation on Renewable Purchase Obligation (RPO) compliance and the Renewable Energy Certificate (REC) framework for 2025. This draft regulation aims to ensure a structured approach to increasing renewable energy consumption in the state while aligning with national policies. BERC has invited public comments and objections before April 11, 2025, and scheduled a public hearing on April 16, 2025.

The regulations will apply to distribution licensees, captive power consumers, and open-access consumers in Bihar. The proposed RPO targets for 2024-25 to 2029-30 include specific percentages for wind, hydro, and other renewable energy sources. Compliance can be achieved through direct procurement, open access, or by purchasing Renewable Energy Certificates (RECs). Penalties will be imposed on entities failing to meet the RPO targets.

The draft regulation integrates updates from the Ministry of Power, including amendments from the Energy Conservation Act. It introduces Distributed Renewable Energy (DRE) compliance and revises Hydro Purchase Obligation (HPO) norms. The regulation also mandates that distribution licensees procure power from waste-to-energy plants.

Monitoring and reporting requirements are included, with obligated entities required to submit half-yearly compliance reports to the Bihar Renewable Development Agency (BREDA). BERC has also outlined penalties for non-compliance, including regulatory charges and the creation of a Renewable Energy Development Fund.

The regulations are designed to promote the adoption of clean energy, facilitate inter-regional power transfers, and support green hydrogen and ammonia production. Stakeholder feedback is expected to refine the final version of the regulation.
